Terms of Service

1. WHO WE ARE

AND ONE ("the Service") is operated by Kévin Bourdeau, sole proprietorship registered in Switzerland with IDE : CHE-200.202.243 ("we", "us"). You can reach us at contact@and-one.app.

By creating an account or using the Service, you agree to these Terms.

2. THE SERVICE

AND ONE is an independent NBA fan application providing statistics, player comparisons, and personalized NBA content. The Service is informational and entertainment-only. It is not affiliated with, endorsed by, or sponsored by the National Basketball Association, any NBA team, or any player. NBA and team names, logos, and marks are trademarks of their respective owners.

3. ACCOUNTS

You must be at least 13 years old to create an account. You are responsible for the security of your login credentials and for the activity on your account. You may delete your account at any time from the app settings.

4. PLANS AND BILLING

The Service includes a free tier and two paid subscription plans (Starter and Pro). Current prices are displayed in the app and on our website, in US dollars.

Full access period: when you sign up, you receive full access to the Service for up to 7 days. After this period, your account is automatically downgraded to the free tier. No charge occurs during this period unless you purchase a subscription.

Payments are handled by Paddle.com, acting as merchant of record. Paddle processes payments, taxes, invoices, and refunds on our behalf. We never see or store your full payment card details.

Subscriptions renew automatically (monthly or annually, depending on the plan you selected) until cancelled. You can cancel at any time through the Paddle customer portal linked in the app's settings. Cancellation stops future renewals; you keep access until the end of the period you already paid for.

We may change prices with reasonable prior notice. Price changes apply from your next renewal; if you do not accept them, you may cancel before the renewal date.

Favorites and fair use

The Pro plan lets you follow teams and players without practical limits. To keep the service stable and prevent abusive or automated use that does not reflect normal human usage, a technical cap of every team available in the app (currently all NBA franchises) and up to 100 favorite players per account applies.

This cap sits far above normal use and is not intended to be reached in ordinary use of the service. When it is reached, adding new favorites is refused; no existing favorite is deleted.

If you move to a lower plan, favorites beyond that plan's limits are kept and paused, and reactivated if you return to Pro.

These caps may be raised at any time without notice; any reduction applies at the end of the current subscription period.

5. REFUNDS

Our refund policy is described in our Refund Policy at https://and-one.app/refund. In short: you may request a full refund of your first purchase within 14 days, no questions asked.

6. INTELLECTUAL PROPERTY

The Service, its design, code, and original content are owned by us. NBA and team names, logos, and marks are trademarks of their respective owners and are used for identification purposes only. Statistics and game data are provided by third-party providers and may be subject to their own terms.

7. NO PROFESSIONAL ADVICE

All statistics, projections, ratings, and comparisons in the Service are provided for informational and entertainment purposes only. They do not constitute financial, betting, gambling, or any other professional advice. Do not rely on them for making betting or fantasy decisions.

8. DISCLAIMER OF WARRANTIES

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that statistics will be accurate, complete, or timely.

9. LIMITATION OF LIABILITY

To the maximum extent permitted by law, our total liability to you for any claim arising from the Service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

10. TERMINATION

You may stop using the Service and delete your account at any time. We may suspend or terminate your account if you materially breach these Terms, with notice where reasonable.

11. PRIVACY

Our collection and use of personal data is described in our Privacy Policy at https://and-one.app/privacy.

12. CHANGES TO THESE TERMS

We may update these Terms. Material changes will be notified in the app or by email before taking effect. Continued use after the change constitutes acceptance.

13. GOVERNING LAW

These Terms are governed by the laws of Switzerland. Courts located in Switzerland have exclusive jurisdiction, to the extent permitted by mandatory consumer protection laws of your country of residence.
